			<content:encoded><![CDATA[<p>At the Wellfleet Annual Town Meeting on April 25, 2011, proposed zoning bylaw amendments to limit the size of houses in non-CCNS residential zones R-1 and R-2 were defeated, failing to gain the needed two-thirds vote. The proposed amendments were prepared by the Planning Board after extensive analysis and public hearing process, and had the approval of the Board of Selectmen.</p>
<p>The proposed amendments would have limited the gross floor area of houses in relation to their lot sizes, based on a study of existing housess, to keep house expansions roughly in line with existing houses.</p>
<p>Related proposed amendments to change the terminology of previously passed Seashore District zoning amendments from &#8220;site coverage&#8221; to &#8220;gross floor area&#8221; were referred back to the Planning Board.</p>

			<content:encoded><![CDATA[<p>The Planning Board will hold a public hearing on March 2, 2011, at 7:00 pm at the Senior Center to receive public comment on proposed zoning amendments affecting houses in Residential Zones R1 and R2 and on &#8220;formula&#8221; businesses in the Central District.</p>
<p>The residential zone amendments would regulate house size with the intention of preserving the traditional character of the Town, as amendments for the Seashore District have already done. Any proposed large, out-of-scale house (relative to its lot size and neighborhood) would have to receive a Special Permit.</p>
<p>They would also allow for more affordable housing.</p>
<p>The fast food and formula business amendments would disallow such stores in the Central District.</p>

			<content:encoded><![CDATA[<p>The United States and Blasch del Mar LLC remain in settlement negotiations in the United States&#8217; appeal of the Land Court&#8217;s dismissal of its challenge to the Blasch building permit.</p>
<p>The United States had previously been given an extension to file its brief in the Massachusetts Appeals Court.  Beginning on June 25, 2010, court proceedings were stayed for 30 day periods to permit final settlement negotiations to proceed.  A status report was filed on July 28, with the stay pending settlement negotiations extended to August 30.</p>
<p>On August 28, the United States and Blasch filed a joint motion to stay the appellate proceedings in order to go back to the Land Court to jointly request that court to vacate its decision and to modify its judgment.  The parties had until September 28 to dismiss the appeal if the lower court decision is vacated or to report back to the Appeals Court if it is not.</p>
<p>On September 20 the parties filed another status report and request for stay of appeal and were granted an extension until October 25, 2010.</p>
